Retired Justice Sounds Alarm on Goa’s ‘Developer-Friendly’ Lawmaking”

Panaji: The chief justice High Court of Allahabad (Retd), Judge High Court of Bombay (Retd) Senior Advocate High Court of Bombay. Ex-MLA, Goa, Justice Dr Ferdino J Rebello, wrote a letter to the Goa Chief Minister to show how the Legislative process has been used to help developers.

Justice Rebello held a press meet in this regard at Porvorim and released the copy to the media.

He said on behalf of the people’s movement “Enough is Enough” he is writing this letter to CM show him how legislative was used for the benefits of developers.

The Justice stated that Section 17(2) considering the the judgement of the High Court be amended I terms thereof and rulesnbe made strictkt in these terms.
He further stated that Section 39A be repealed forthwith retrospective effect i. e. the data on which it came into force.

He added that Section 17A be amended to prevent any development or cutting of Hiil-slopes, as they are part of our ecology and environment and have to be preserved for our future generations; adding that Section 32 of Land Revenue Code be repealed and restored as to how it originally stood before it’s amended in 2024;

He further informed that Section 2(e) Restriction of Transfer of Agricultural Land Act, 2023be defeated, and provision be made for banning of all agricultural lands as per definition of “Agriculture” In the Goa Agricultural Tenancy Act.

The department of vigilance, government of Goa whilst conducting an inquiry pursuant to directions of the High Court perhaps shocked by what it noted in the files has submitted a preliminary inquiry report dated 25th April 2025.

The report in paragraph 19 shows that the Vigilance Officer had considered only 11 numbers of files out of 119 files and each and every file which was examined demonstrated a total misuse of power. The Report was obtained under the RTI Act by an activist. Immediate action should be taken to lodge an FIR based on this report and the Vigilance Department be asked to check and give their comments on the other 108 files.
